1. Introduction

Welcome to the Midtown Authentic Mobile Application (the “App”). This User Agreement (“Agreement”) governs your use of the App provided by Midtown Authentic (“we”, “our”, or “us”). By using the App, you agree to abide by the terms and conditions set forth in this Agreement.

2. Service

The App provides a platform for users to request a quotation for their products, which Midtown Authentic commits to purchasing at the agreed-upon price should the user accept the quotation. Additionally, users can participate in auctions or make direct offers to purchase items.

3. Quotation Requests and Sales Commitment

When you request a quotation for your product, we will provide a purchase price. If you accept this price, you are obligated to sell the item to us at the quoted price.
If you decide to accept the quotation, a binding agreement is formed between you and Midtown Authentic, obligating you to sell the item at the agreed-upon price.
Upon receiving the item, we reserve the right to refuse the transaction if the item is found to be inauthentic or if its condition significantly deviates from the condition depicted in the provided pictures. It’s essential that all photographs accurately represent the item’s condition, including any damages or wear. Failure to disclose such information may result in the cancellation of the transaction and/or additional penalties.

4. Purchases, Live Stream Sales, and Penalties

Users can purchase items through live stream sales or direct offers. If you claim an item during a live stream sale or confirm a direct purchase, you are legally obligated to complete the transaction.
In case of failure to complete the transaction, we reserve the right to ban the user from the platform and block their access. If a banned user re-registers on the platform, we reserve the right to ban the user again.

5. Payment and Delivery

Payment and delivery terms will be provided at the time of transaction and are binding upon confirmation of the purchase or acceptance of the quotation.

6. Disclaimer of Warranties and Limitation of Liability

The App and services are provided “as-is” and we disclaim any warranties, either expressed or implied, regarding the App including, but not limited to, fitness for a particular purpose and non-infringement.
In no event shall we be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to this Agreement.

7. Modifications to Agreement

We reserve the right to modify this Agreement at any time. Any modifications will be posted on the App and will be effective immediately upon posting.
